On March 26, 2015 a Mr. Todd Stimson of North Carolina was sentenced to prison for no less than two years for the simple acts of growing and possessing cannabis. This sentencing was both completely legal and completely unjust. It does not represent an isolated error within the justice system, but a systematic one. The objectives of legitimatejustice systems include the following:

1.     Identify and apprehend criminals

2.     Punish criminals

3.     Ensure victims of criminal behavior are provided restitution by their perpetrators

Implicit in these tasks is the fundamental truism that crimes, by their very nature, mustproduce victims. Activities which, in themselves, produce no victims cannot be crimes. In order for one to understand the essential nature of crimes, he must likewise acquire an understanding of liberty. Liberty is defined as freedom from the uninvited physical interference of one’s person and property. Thus, in addition to producing victims, crimes must also entail violations of liberty. 

With this basic premise set, it becomes quite clear that the mere production, consumption, possession and sale of any substance, in itself, cannot be considered criminal. This, of course, applies to cannabis. Furthermore, to forcibly confiscate and destroy someone’s property and throw him in a cage against his will for engaging in such acts, is itself criminal. It is for this reason that prohibition necessarily involves the curtailment and outright violation of the liberties of countless individuals.  

In addition to its affront to justice, prohibition produces crippling economic effects. Millions of individuals who would otherwise be providing desired goods and services in the market, are instead locked away against their will while taxpayers are forced to bear the financial burden of their imprisonment. To add insult to injury, billions of dollars are spent finding and apprehending these non-criminals (money which may have otherwise been allocated towards more productive ends).

In closing, I refuse to ask that you provide Todd Stimson with a full pardon. Instead, Idemand you unconditionally pardon him and do whatever is in your power to end prohibition immediately.
