Appeal 8-1-2014 

LEADER OF DALLAS MARIJUANA DISTRIBUTION RING SENTENCED TO LIFE IMPRISONMENT

Dear Ms. Falk, my name is Ferrell Damon Scott 51 years old and I am currently incarcerated serving a life sentence without parole for a marijuana conviction out of Texas. I am trying now to get my case back into court. I of course lost my direct appeal and my 2255 motion was denied but I appealed the denial of my 2255 motion and asked for COA ( Certificate Of Appealibility) from the Appeals Court for the 5th Circuit and it was granted! I was very happy about that but the fight has just been restarted with their granting me the COA. It is very difficult to even be granted a COA without the "substantial showing of the denial of one of your constitutional rights". Apparently I met this showing because I was granted the COA so hopefully I will win this appeal or I am dead in the water. I just put my brief in a few weeks ago so I am now waiting on an answer from the Appeals Court and I pray that it goes in my favor but I know the courts do not like accepting good law from an inmate but I think I have a good chance but you always think that until they turn you down. I found out after my trial was over that one of the women that sat on the jury was romantically involved in a relationship with one of the prosecuting attorney's that prosecuted me and of course they claimed that the contact didn't start until after my trial. My lawyer didn't even file this on my direct appeal so now my issues on the COA are ineffective assistance of trial and appeal counsel. I am trying to prove a juror bias claim.
