77-year-old sentenced to 10 years for growing marijuana
A search warrant would be obtained, and investigators would eventually say White was growing more than 1,700 marijuana plants.
It appears no details have been reported on the case since a 2012 news release, when the Polk County sheriff announced the biggest indoor marijuana bust in his more than 20 years in law enforcement.
On Wednesday, White, now 77 with failing eyesight, walked into the federal courtroom with a cane in his hand and chains around his feet.
Judge Douglas Harpool struggled with his decision to sentence White to 10 years in prison. He said he researched any way he could give White less than the 10-year-minimum sentence but failed to find one.
“This is not a sentence I feel particularly good about.” Judge Douglas Harpool
White's attorneys have long argued that the case should have never reached a sentencing, saying White has been unfairly targeted by local, state and federal authorities.
Authorities already had their eye on White long before March 2012, his attorneys say, when overzealous detectives illegally stepped on his property — and trampled his constitutional rights.
According to a motion filed by White's attorneys, this case didn't begin with a woman's identity being stolen — it began in a Kansas City parking lot in 2010.
Court records show that a Missouri State Highway Patrol sergeant observed White and another man leaving a hydroponics store and filling a pickup truck with plant-growing equipment.
According to court filings, White was the focus of a brief investigation.
Details of that investigation were never passed onto the Polk County Sheriff's Office, the federal prosecutor said.
The discovery of more than 1,700 marijuana plants on White's property, authorities said, was just luck.
The detectives testified that they had never met or heard of White before coming onto his property in March 2012.
The detectives also said they didn't notice a gate with a "No Trespassing" sign when they drove down White's driveway.
That's not true, White said in court filings. The gate was closed, he said, and they had no right to open it and enter his property.
Two neighbors testified in court, saying they had lived next to White for years, and he never had his gate open. One said he saw officers approach the gate that day, get out of their car, undo the chain and open the gate.
Authorities twice went onto White's property before obtaining a search warrant, court records show.
White's attorneys filed a motion to suppress evidence in the case, but a federal judge ruled against White.
In another attempt to have the case dismissed, in 2015, White's new attorney Jason Coatney said federal law was being unfairly applied to White. In a motion, Coatney said the federal government has a "schizophrenic" approach to marijuana laws.
Prosecuting White for something that would be legal in Colorado is a violation of White's 14th Amendment rights, Coatney argued.
If the federal government is letting it happen in Colorado and other states, Coatney said, they should let it happen in Missouri.
Coatney also pointed to 2013 guidelines from the Department of Justice that told federal prosecutors to prioritize marijuana cases that involve organized crime or distribute to children — neither of which apply to White.
A federal judge ruled against White, and the case again moved toward trial.
In February, White pleaded guilty to manufacturing more than 1,000 marijuana plants.
Since early 2015, White has been housed at the Greene County Jail.
A pre-sentencing report calculated that White should serve at least 24 years in prison. That was partly due to White's criminal past. He was convicted in 1990 of manufacturing more than 600 marijuana plants and in 2004 of manufacturing more than 100 marijuana plants.
Under a plea deal, the federal prosecutor suggested the minimum sentence under U.S. law: 10 years.
Coatney suggested home confinement, but Harpool, the judge, said that couldn't apply.
Harpool eventually sentenced White to 10 years in prison but said he would suggest that the Bureau of Prisons consider a "compassionate release" for White.
Four people — family and friends of White — came to the sentencing hearing. They were upset at the sentence and upset the case was never thrown out.
"He's a good man. He's always been happy and cheerful," White's stepdaughter, Valerie Patterson, said. "He's never had a history of violence."
Robert Murphy, a friend, said officers entered White's property unlawfully.
"He's a farmer. He's always been a farmer," Murphy said. "When he was busted, he was busted illegally."

Indiana Man Sentenced for Role in 10-Defendant Marijuana Conspiracy
Members of south Texas drug trafficking organization sentenced to federal prison
BROWNSVILLE, TX—Delton Hinderliter, 37 of Indianapolis, Indiana, has been sentenced to 112 months in federal prison for his role in a 10-defendant marijuana conspiracy, announced U.S. Attorney Kenneth Magidson. Hinderliter pleaded guilty in May 2014 to conspiracy with intent to distribute a quantity exceeding 1000 kilograms of marijuana.
Hinderliter was part of a multi-state drug trafficking and money laundering organization that had existed since 2010. The drug trafficking organization, based out of the Rio Grande Valley, would hire out-of-state truck drivers to haul loads of produce with ton quantities of marijuana hidden in false compartments. Drug proceeds would then be transported back to the Rio Grande Valley. The conspiracy extended to Indiana, Kentucky, Illinois, North Carolina and Tennessee.
The evidence at sentencing proved that Hinderliter was a distributer of marijuana for the drug trafficking organization in Indiana. Hinderliter’s sentence includes upward adjustments or increases in his calculated sentencing guideline range because he was found to have maintained a premises to facilitate the offloading, processing and distribution of illicit narcotics, and because he was found to be a leader within the drug trafficking organization. As part of his sentence, Hinderliter agreed to a $5 million money judgment against him. Five other individuals charged and convicted in the case were previously sentenced to terms ranging from 38-189 months in federal prison. Four others have also been convicted and are pending sentencing.
The case was the result of a nearly three-year Organized Crime Drug Enforcement Task Force investigation lead by the Drug Enforcement Administration with the assistance of Internal Revenue Service-Criminal Investigation; Homeland Security Investigations; Bureau of Alcohol, Tobacco, Firearms and Explosives; FBI; Sheriff’s Offices in Cameron and Zapata Counties; Hildalgo County High Intensity Drug Trafficking Area task force; Border Patrol and the Brownsville Police Department. Assistant U.S. Attorney Angel Castro is prosecuting the case.

Two Tons Of Marijuana Seized In McHenry County
A marijuana growing operation at two homes in McHenry County was raided this week by the Lake County Metropolitan Enforcement Group, the McHenry County Sheriff, and federal authorities. Together, they collected 2,200 plants from a home in the 7900 block of Maple Street in Marengo and 2,100 plants from a home in the 17600 block of Kishwaukee Valley Road near Woodstock, or about $6.6 million in marijuana plants altogether.
Each plant yields about a pound of dried marijuana and has a street value of $1,500 per pound, said MEG Deputy Director Jeff Padilla. "These guys were professionals. This was their business," he said. The operations included grow lights, drip lines, ventilation, air purification units and illegal power lines run off the main line to hide the fact they were using a lot of electricity.
Charged with conspiracy to manufacture marijuana were Robert Cain, 47, of Cary; Charles Persico, 32, of Hoffman Estates; Jerry Romine, 30, of Woodstock; Jonathan Romine, 32, of Lake in the Hills; Loretta Cattani, 56, of Union; and Robert Stringini, 71, of Schaumburg. Padilla said that those arrested are family members and the continuing investigation could lead to more arrests. Police also found 4,400 pounds of marijuana growing and 500 pounds of dried marijuana ready for packaging. The two houses were owned by family members and not rented.

Jury Convicts Columbia Man Of Marijuana Conspiracy
JEFFERSON CITY, Mo. – Beth Phillips, United States Attorney for the Western District of Missouri, announced today that a Columbia, Mo., man has been convicted by a federal jury of conspiracy to distribute more than 100 kilograms of marijuana in Boone County, Mo.
Eric Scott McCauley, 29, of Columbia, was found guilty on Wednesday, March 16, 2011, of 29 counts contained in an April 3, 2009, superseding indictment.
The original indictment in this case was filed in March 2007 in the wake of one of the largest seizures of marijuana in the history of the Columbia, Mo., Police Department. Evidence presented during the trial indicated that McCauley led a drug-trafficking conspiracy that was responsible for distributing more than 100 kilograms of marijuana in Boone County from 2005 to December 2008. During the investigation, law enforcement officers seized $224,663 cash attributable to/owned by McCauley.
In addition to the drug-trafficking conspiracy, McCauley was convicted of one count of distributing marijuana and two counts of possessing marijuana with the intent to distribute.
McCauley was also found guilty of participating in a money-laundering conspiracy. McCauley was also convicted of 24 counts of money laundering related to transfers of funds derived from the drug-trafficking conspiracy or conducting financial transactions that were designed to conceal the location of drug-trafficking proceeds.
Co-defendants Robert Allen Hocks, 29, and Galen Cutter Baxley, 27, both of Columbia, have pleaded guilty to their roles in the drug-trafficking conspiracy. McCauley and his co-conspirators often traveled to Massachusetts and California to purchase high-grade marijuana, which they redistributed in Boone County.
When Columbia police officers executed a search warrant at a stash house at 4647 Brandon Woods, Columbia, on Feb. 7, 2007, they discovered more than 240 pounds of marijuana. The drug-trafficking conspiracy continued for more than a year afterward, during which time McCauley and Baxley moved to Kansas City, Mo. In December 2008, law enforcement officers discovered approximately 12 pounds of marijuana in the trunk of Baxley and McCauley’s vehicle, which was parked on the street in front of McCauley’s apartment building.
Following the presentation of evidence, the jury in the U.S. District Court in Jefferson City, Mo., deliberated for about five hours hour before returning the guilty verdict to U.S. District Judge Nanette K. Laughrey, ending a trial that began Monday, March 14, 2011.
Under federal statutes, McCauley is subject to a mandatory minimum sentence of five years in federal prison without parole, up to a sentence of 45 years in federal prison without parole. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.
This case is being prosecuted by Assistant U.S. Attorneys Lauren Kummerer and Jim Lynn. It was investigated by the U.S. Drug Enforcement Administration, IRS-Criminal Investigation and the Columbia, Mo., Police Department.
