Dale Wayne Green is serving LWOP- meaning he is serving Life Without the Possibility of Parole. Speciallically, for his role as middleman in a sale of $20 worth of marijuana to an undercover agent.
September 1999, Caddo Parish Sheriff’s Office undercover agent for the narcotics division was driving around near Keithville, Louisiana. The undercover agent saw Green stopped on the side of the road. The agent stated Green asked the him if he was looking for anything? When the agent responded that he was looking for some weed. Supposedly, Dale agreed to take him to where he could buy some marijuana. Eventually, Mr. Green found a young man to sell the agent a $20 bag of marijuana. The undercover-agent said he paid Green $10 for his help. As the agent’s vehicle was equipped with surveillance equipment his incident was recorded. However, the sound was not functioning and the surveillance video tape was of poor quality. Most importantly the video did NOT capture any purchase of the marijuana. On a later day the agent identified Green and after the undercover operation was completed he was arrested on November 1999.
Sadly, Dale Green was convicted of distribution of marijuana and sentenced to a mandatory life-without-parole sentence because he was a third-time offender- and his case was adjudicated under Louisiana’s multiple offender law. Dale had two prior convictions: in 1990 he had pled guilty to attempted possession of cocaine and in 1991 to simple robbery. According to Green, when he pled guilty to these prior charges he was never informed of the nature or elements of the crimes, or that these convictions could be used to enhance his sentence under the multiple offender law if he committed subsequent offenses.
Tragically, Mr.Green had no lawyer to represent him on appeal. Dale had unsuccessfully tried to raise the claims that he had been entrapped with insufficient evidence to convict him.

From Elizabeth-
In February of 2013 my brother was sentenced to LIFE for conspiracy to distribute Marijuana.
The case # is CAUSE NO. 4:11-CR-127.6. Prior to this conviction, my brother has never had any violent cases. He had been raised, and was currently living in Indianapolis, Indiana. Approximately 1.5 years prior to his sentencing he was on a work release program getting his life on track, he had 2 weeks remaining of his program before he would successfully complete it, along with holding down a job.
It was then that the Federal Drug Taskforce came to his home, took him from his home and transported him down to Dallas Texas, where he has never lived. They also transported apprx. 15 other gentlemen from the State of Indiana down to Texas. My brother was taken away from all his friends, and all of his family. He did not understand what was going on, only to find out the Federal Government had taken his state case, and turned it into a Federal Case, the State case which he was almost finished serving.
The Federal Government did not catch my brother with any marijuana on him, nor did they see him conduct any transactions. The entire case is based upon hearsay from other individuals. My brother has never been a snitch, so for this case, he would not speak, or make up stories regarding other people. Once the case was heard, my brother was sentenced to LIFE in prison. While the individuals that were “supposedly” higher in this case, were only presented with 12 years.
This is completely wrong, and unjust. My brothers case is currently in the 5th district court of appeals in Louisiana, waiting to be heard. He has a court appointed lawyer whom we have not had much cooperation with. We are asking for all the help that we can get. My brother has 3 amazing children who he LOVES and adored and spent the majority of his time with prior to this case. He has NEVER been a violent person, does not have ANY convictions for being a violent person, he has NEVER lived in the state of Texas, nor “conducted transactions” (As the case states) in the State of Texas. Although, I am not saying that a charge of conspiracy to distribute does not warrant some type of jail time, I do not believe that it warrants a LIFE in prison sentence.
My brother was given longer sentences than MURDERS and CHILD PREDATORS!
This type of sentencing MUST STOP in our courts today! Please sign my petition asking the 5th district court of appeals to hear my brothers case and provide a clemency, or shorter sentence.
Please feel free to review my brothers case as well to understand the details. I thank you very much for taking the time to read this.

Offense: Conspiracy to possess with intent to distribute 1,000 kilograms or more of marijuana; attempt to possess with intent to distribute 1,000 kilograms or more of marijuana (Northern District of Florida)
Sentence: Life imprisonment (Jan. 8, 1992)

President Obama Grants Commutations and Pardons
Sadly, Charles is a LWOP POW- this means Life Without the Possibility of Parole. So,Charles Frederick “Fred” Cundiff a 66 year old white male is serving LWOP for cannabis. Specifically for importing marijuana. Charles was sentenced to life without parole for conspiracy to import and distribute over 1,000 kilos of marijuana.
Charles has been in Federal Prison since 1991; he has served 22 years in federal prison.
Charles had a happy life prior to his arrest. He worked in a variety of fields: at a plant nursery, he worked construction, he was a mortgage solicitor, and a manager at a stereo store. Charles is Father to three children, a grandfather to nine grand-children, and a great-grandfather 6 great grand-children. The Cundiff family is as much of victim as is Charles on this failed War on Drugs. Charles is blessed to have regular visits by two friends from his youth.
Sadly, after Mr. Cundiff has worked steadily for 12 years of his imprisonment has had to stop working due to his declining health. He has became seriously ill and now requires a walker. In addition, Charles is suffering from skin cancer, a dropped foot and shrunken leg due to severe arthritis and spinal surgery, disintegration of orbital bone due to chronic infection, and vision problems.
United States v. Cundiff et al., No. 91-03069-06/RV (N.D. Fl.), affirmed 16 F.3d 1231 (11th Cir. 1994). At sentencing, the trial judge said that he would sentence Mr. Cundiff to 15 to 20 years, that however such a sentence would be reversed on appeal.
Of prison, Cundiff says, “If I should die and go to hell, it could be no worse.”
This is a sad reality for many Americans. Please, share this story. America needs to know that our citizens are doing life in prison for a plant. And, NO-ONE BELONGS IN JAIL FOR A PLANT.

Man sentenced in Charlotte for trafficking tons of marijuana
Corvain Cooper was sentenced to life in prison shipping marijuana into Charlotte, federal officials said.
Corvain Cooper, 34, of Inglewood, Calif., was sentenced Wednesday in a federal courtroom in Charlotte. He and two co-defendants, Evelyn LaChapelle and Natalia Wade, had been convicted last Oct. 18 following a three-day trial.
Court records show Cooper had been charged with conspiracy to distribute and to possess, with intent to distribute, at least 1,000 kilograms of marijuana.
According to federal court documents and evidence presented at the trial, the marijuana was shipped to the Charlotte area in commercial crates and overnight delivery packages. During the trial, federal prosecutors alleged that more than 35 tons of marijuana was shipped to Charlotte and millions of dollars funneled back to suppliers in California.
Cooper was arrested in California on Jan. 28, 2013, as part of an investigation nicknamed Goldilocks. More than 55 people have been convicted for marijuana trafficking, money laundering and firearms violations during the past five years as a result of the investigation, according to federal authorities.
Cooper received a life sentence because of the drug amount involved and because of two prior felony drug convictions in California, authorities said. Federal sentences are served without the possibility of parole. LaChapelle and Wade are awaiting sentencing.
