In early 2000, the FBI began an investigation into a cocaine ring in Cleveland's eastern suburbs. After attempts to use undercover agents to pursue suppliers further up the distribution chain were unsuccessful, a wiretap investigation was pursued which culminated in a tap being placed on Alfred Laudato's (“Laudato”) cellular telephone. Laudato was supplying numerous customers in the Cleveland area with cocaine and also with marijuana. Harb sold marijuana to and purchased cocaine from Laudato, while DeJohn purchased marijuana from Laudato.
In June 2000, the FBI terminated the investigation, making numerous arrests and searching both Harb's and DeJohn's residences. At DeJohn's residence, drug distribution paraphernalia (plastic bags and a three-beam scale stored together) and eight separate bags of marijuana were found together in a duffel bag. Additionally, two firearms were found, a small handgun along with ammunition in a drawer underneath the couch in the family room, and a Remington 870 shotgun in a bedroom closet upstairs. At Harb's residence, numerous firearms were discovered, totaling three pistols and four rifles, as well as a bag of marijuana. Harb and DeJohn were both indicted with twenty-six other individuals on June 13, 2000, and then arrested as part of the raids on June 14, 2000.1 Two superseding indictments were filed, one on July 11, 2000, with additional codefendants, and a second superseding indictment on October 3, 2000, which named far fewer conspirators as so many had already pleaded guilty. Harb and DeJohn, however, ultimately refused to plead guilty, and were eventually the only defendants left.
The government's motion to dismiss the indictment against them without prejudice was granted on November 13, 2000, and on December 28, 2000, they were reindicted; this later indictment was the first containing the firearms charges against DeJohn.

My sister told me this morning that she received a call from the Northern District Probation Office regarding a pending compassionate release. Her and her husband of 54 years was interviewed in person at their home wihin the hour by two Santa Rosa Federal Probation Officers. They told my sister and brother-in- law that approved paper work will be submitted from their office this week. Release could be within one week or 6-months. Hallelu-Yah! Yahvah is Good! 28-years, 5-months, and 17-days and counting, as a political federal prisoner as a contract carrier, based solely upon the government prosecutor's creative misapplication, of the marijuana laws, under color of a Life Sentence, a death sentence, without an Act of Congress.
May 1988, Special Agent Norman Wood, US Customs Service, after almost a year long undercover investigation, seized the ocean going tug boat Intrepid Venture towing a drug filled barge under the Golden Gate Bridge, San Francisco, CA. Calvin Robinson, a career criminal with international organized crime connections, was trying to smuggle 56 tons of hashish and marijuana into the United States. The hashish came from southern Russia. It was the largest drug seizure ever made within the United States. Street value was over 1 billion dollars. Broken down into dosage units, there was enough drugs to be given to every man, woman and child in the U.S. The year before, Robinson successfully smuggled 30 tons of Hashish into the San Francisco Bay. Calvin Robinson choose to represent himself in Federal Court. He questioned Special Agent Wood on the stand. Robinson was found guilty and sentenced to life without the possibility of parole. Special Agent Wood left the government in 1992. He is now a doctor and inventor.

Today was awesome..spent the day with Free Jeff Mizanskey- Clemency for Jeff Mizansky in prison for LIFE for because of unjust cannabis laws. Today Jeff turned 62 years old and I was thrilled to spend the day with Jeff, his brother Mike, and sister-in-law Joann Corbett-Mizanskey. Jeff ate so much - he literally ate till it ouched him....Wow...Jeff had an avocado for the first time today....#FREEJEFF.

POW420 is very excited to spend the day with Jeff Mizanskey serving a life sentence for marijuana. We got pre-approved for a food visit on his birthday - April 25th, Saturday. This will be his 21st birthday spent in prison for unjust cannabis laws.
We will be joined by Mike and JoAnn Mizanskey, Jeff's brother and sister in law.
I spend all day Friday prepping food for Jeff. As his request, he wanted BLT's. So, we made home-made bread, bacon, avocado, lettuce, onions, cheese, and a fried egg. Including, home-made potato salad, some olives, some home-made chips, and a chocolate moose. Most importantly, bacon and deep friend bacon- and the eggs are cooked in bacon fat.
Mike is also bringing some subs from Chicago. This will be a great day - we can manifest this be his last birthday Jeff ever celebrates behind bars. No-one belongs in jail for a plant.

Hector “Ruben” McGurk was charged on August 18, 2002 and went to trial in December of 2004. At this trial he was acquitted of Count 2 – Importation of marijuana. At this trial the defense did not offer any exculpatory documents and no defense witnesses were called the jury simply did not believe the government proved its case.
In April of 2005 Ruben was retried on conspiracy to possess and distribute marijuana and conspiracy to money-launder. At this trial, Hector was convicted and sentenced to life without parole. Ruben is a first time offender and there is no violence in the case or his past. Conspiracy is a charge that only requires testimony rather than physical evidence.
Until this year Ruben had been incident free in the BOP even though as a nonviolent marijuana offender he was housed with inmates convicted of violent crimes. This demonstrates an inordinate amount of self-control.
Because he is housed far from his family, for economic reasons he has not have visits for eight years.

LEADER OF DALLAS MARIJUANA DISTRIBUTION RING SENTENCED TO LIFE IMPRISONMENT
Dear Ms. Falk, my name is Ferrell Damon Scott 51 years old and I am currently incarcerated serving a life sentence without parole for a marijuana conviction out of Texas. I am trying now to get my case back into court. I of course lost my direct appeal and my 2255 motion was denied but I appealed the denial of my 2255 motion and asked for COA ( Certificate Of Appealibility) from the Appeals Court for the 5th Circuit and it was granted! I was very happy about that but the fight has just been restarted with their granting me the COA. It is very difficult to even be granted a COA without the "substantial showing of the denial of one of your constitutional rights". Apparently I met this showing because I was granted the COA so hopefully I will win this appeal or I am dead in the water. I just put my brief in a few weeks ago so I am now waiting on an answer from the Appeals Court and I pray that it goes in my favor but I know the courts do not like accepting good law from an inmate but I think I have a good chance but you always think that until they turn you down. I found out after my trial was over that one of the women that sat on the jury was romantically involved in a relationship with one of the prosecuting attorney's that prosecuted me and of course they claimed that the contact didn't start until after my trial. My lawyer didn't even file this on my direct appeal so now my issues on the COA are ineffective assistance of trial and appeal counsel. I am trying to prove a juror bias claim. I was given your information by a friend I have here named John Knocks who is also serving a life sentence for pot.Thank You very much for accepting my e-mail and I hope there is something you can do to help me out.

Leland Dodd is serving LWOP in Oklahoma for trying to buy 50 pounds of weeds from an undercover officer, or as he puts it, “talking about buying some weeds.” He was arrested before the sale concluded.

Dodd believes he is the first prisoner to be sentenced to mandatory LWOP for a nonviolent drug crime under Oklahoma’s habitual offender law. He was sentenced to LWOP in 1991 for, as he puts it, “talking about buying some marijuana.” Dodd is the father of three children, and prior to his incarceration he worked as a trim carpenter. He tried to buy 50 pounds of marijuana from an undercover police officer posing as a seller, and he was arrested before the sale was concluded. He was convicted in February 1991 of conspiracy to traffic in marijuana and possession of marijuana with intent to distribute. He was sentenced to a mandatory life-without parole sentence because of his four prior drug felonies dating back to 1978, which included convictions for possession of marijuana with intent to distribute and possession of an unlicensed firearm he made from a kit he bought at a gun show. Under the sentencing guidelines, based on his prior offenses, his sentence would have been 13.5 years.
Now 59, Dodd has served 22 years of his sentence. Since his incarceration, he has divorced from his wife of 17 years. He told the ACLU, “I don't see the point, I mean I don't even smoke weed anymore. What’s the threat here? When I was on the street, I went fishing and I smoked joints…I wasn’t hurting anyone.”
